This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and the learned Standing Counsel for Vigilance department. Perused the records. 3.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

It is submitted by the learned counsel for the Petitioner that the present Petitioner is aged about 80 years and he is not the principal accused in the present case. Further, considering the background of the case, the Petitioner apprehends his arrest. 5.

Learned Standing Counsel for Vigilance department submits that preliminary investigation is going on and no formal F.I.R. has

Considering the factual background and the age of the Petitioner, this Court directs the Arresting Officer to release the Petitioner on bail in the event of his arrest in Cuttack Vigilance Misc.Case No.11 of 2022 pending before the learned Special Judge, Vigilance, Cuttack on such terms and conditions as would be deemed just and proper by the Arresting Officer with further condition that the Petitioner while on bail shall cooperate with the investigation. 6.

Accordingly, the ABLAPL is disposed of.
