This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioners as well as learned counsel for the State.

In view of the submissions made, the order dated 14.09.2022 is hereby recalled. Accordingly, the I.A. stands allowed. ( A.K. Mohapatra ) Judge BLAPL No.7826 of 2022 03.

The petitioner is seeking pre-arrest bail in connection with C.T.(NDPS) No.05 of 2021, arising out of Chhendipada P.S. Case No.390 of 2022 pending in the court of learned Sessions Judge-cum-
// 2 // Special Judge, Angul for commission of offence punishable under Sections 20(b)(ii)(C)/29 of the NDPS Act.

Considering the submissions made by learned counsel for the respective parties and considering the allegations made against the petitioner and period of detention of the petitioner, it is directed that let the petitioner be released on bail on furnishing a bail bond of Rs.50,000/- (rupees fifty thousand) with two local solvent sureties each for the like amount to the satisfaction of the learned court in seisin over the matter along with cash security of Rs.20,000/- (rupees twenty thousand) besides other conditions would be imposed by the learned court below while releasing the petitioner with further conditions that :- I.
The petitioner shall not be involved in any offence of similar nature;
II.
he shall not tamper with the prosecution evidence or try to threaten or influence the witnesses in any manner whatsoever;
III. he shall not make any default in attending the court during trial on each date without fail; and IV. he shall appear before the concerned Police Station once in a week preferably on 'Sunday' in between 10.00 A.M. to 1.00 P.M. till conclusion of trial.
Violation of any of the terms and conditions shall entail cancellation of bail.

It is further directed that the bail granted to the petitioner is subject to the condition that learned court below shall verify whether
// 3 // the petitioner has more than three criminal antecedents of similar nature. In the event it is found that the petitioner has more than three criminal antecedents of similar nature, this bail order shall automatically stand revoked.

The BLAPL is accordingly disposed of.
