This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.830 of 2021, pending in the file of learned J.M.F.C., Soro, arising out of Soro P.S. Case No.392 of 2021, under Section 392/307/34 of IPC and 25 and 27 of the Arms Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Asst. Sessions Judge, Soro by order dated 27.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that the petitioner has been remanded in the case at hand because of his criminal proclivity.

Learned counsel for the State relying on the statement of one Srikanta Mohanty-informant submits that the Firearm was recovered from the petitioner. Hence, charge sheet has been filed in the meanwhile petitioner ought not to be released on bail. 7.
This Court had occasion to peruse the statement of one Srikanta Mohanty and keeping in view the seizure of the firearm from the petitioner including live ammunition and his criminal proclivity as noticed in the order of rejection, this Court is not inclined to entertain his bail application at this stage. 8.
It shall be open to the petitioner to move this Court after examination of the informant.

Accordingly, the BLAPL stands disposed of.
