This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

This I.A. has been filed for preponement of the bail application.

4.

Considering the recitals in the I.A., the I.A. has become infructuous with the efflux of time.

The petitioner is an accused in G.R. Case No.2840 of 2022, pending in the file of learned S.D.J.M., Sambalpur, arising

out of Hirakud P.S. Case No.174 of 2022, offence under Sections 493/417/506 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cum-Spl. Court (under POCSO Act), Sambalpur by order dated 29.07.2022 in the aforementioned case, the present BLAPL has been filed. 3.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 18.07.2022 and charge sheet has been filed on 25.07.2022, further continuance of the petitioner in custody is not warranted.

Taking into account the nature of allegations and filing of charge sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
