This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.1194 of 2022, pending on the file of the learned S.D.J.M., Khordha, arising out of Khordha Model Police Station P.S. Case No.356 of 2022, offences under Sections 420/120(b)/406/414/34 of IPC and is in custody since 30.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additionall Sessions Judge, Khurda, by order dated 11.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that co-accused have been release on anticipatory bail by this Court, namely Subrat Pani by order dated 12.09.2022 in ABLAPL No.10904 of 2022 and Satyajit Mohapatra @ Dipu by order dated 04.08.2022 in ABLAPL No.9177 of 2022.

It is further submitted that one Santanu Sahoo and Sahil Khan have been released on bail by this Court by order dated 05.09.2022 in BLAPL No.7955 of 2022 and dated 14.09.2022 in BLAPL No.8305 of 2022 respectively. Hence learned counsel for the petitioner seeks release of the petitioner on the ground of parity. 7.

Taking into account the nature of allegations and release of the co-accused and role ascribed to the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
