Mr. Mohanty, learned counsel for the petitioner contended that there is imminent danger of eviction of the petitioner form his residential house vide Annexure-1 during the rainy season by announcement in mike. He further contended that OPP Case No. 91 of 2002 is still pending, therefore during the pendency of the case, no step for eviction should be taken.

Mr. A.K. Mishra, learned Additional Government Advocate contended that he has no instruction whether OPP Case No. 91 of 2002 is still pending or not. If the matter is still pending, it is open to the petitioner to apprise to the authority concerned about the announcement of mike, which is alleged in the present writ petition. 5.

Having heard learned counsel for the parties, this writ petition stands disposed of permitting the petitioner to agitate before the authority where OPP Case No. 91 of 2002 is pending as stated by learned counsel for the petitioner with regard to announcement in mike for his eviction. In case such a grievance is made, the authority concerned shall consider and pass appropriate order in accordance with law.
