Bisoi, learned counsel appearing for the Petitioner, Mr. R.N. Mishra, learned Additional Government Advocate appearing for the State-Opposite Parties No.1 to 3 and Mr. S.K. Patra, learned counsel appearing for the Opposite Party No.4.

Mr. S.K. Patra, learned counsel appearing for the Opposite Party No.4, on instruction, submits that the pension papers of the Petitioner has not been resubmitted on being returned by the Senior Accounts Officer, Office of the Accountant General

Mr. R.K. Bisoi, learned counsel appearing for the Petitioner submits that the absconding report as required by Accountant General has been submitted by Deputy Commissioner of Police, Bhubaneswar before the Opposite Party No.3 vide his letter dated 2.8.2022 under Annexure-14 to the writ petition. However, it is submitted that in spite of receipt of such report, Opposite Party No.3 is not resubmitting the pension papers of the Petitioner and thereby the Petitioner is deprived from getting the family pension.

In view of such submission made by the learned counsel for the parties, this Court, while disposing this writ petition, directs the Opposite Party No.3 to resubmit the pension papers of the Petitioner as required by Opposite Party No.4 under Annexure-12 within a period of one month from the date of receipt a copy of this order. Opposite Party No.4 is directed to sanction the same within a further period of one month from the date of receipt of such pension papers from the office of Opposite Party No.3. Petitioner is directed to produce a copy of this order before the Opposite Party No.3 within seven days from the date of receipt of this order.
