This matter is taken up through hybrid mode.

In compliance of the order dated 19.09.2022, Dr. Biswajit Das, Sub-Collector, Bhawanipatna appears in person and files an affidavit, paragraphs-3, 4 and 5 of which read thus:- "3. That, pursuant to the affidavit dated 16.09.2022 filed by the present deponent, the deponent undertakes to follow the statutory rules scrupulously and diligently. 4.

That, the deponent undertakes to promptly number all appeals filed before him and communicate the same to the appellant without delay.

That, the deponent humbly submits that in all further proceedings that are the statutory responsibility of the deponent, the deponent will follow all such statutory provisions diligently and without demur."

In view of the above statement made in the affidavit itself, since in the meantime the appeal has been entertained and the parties have already been noticed, this Court directs the petitioner as well as the opposite parties to remain present before the SubCollector, Bhawanipatna on 27.09.2022, on which date the SubCollector shall fix a date of hearing. 4.

Mr. S.K. Joshi, learned counsel for the petitioner undertakes to communicate to his client the date of appearance before the

Sub-Collector, Bhawanipatna.

In the above view of the matter, since the relief sought has already been granted, the writ petition stands disposed of. 6.

Personal appearance of Dr. Biswajit Das, Sub-Collector, Bhawanipatna is dispensed with.
