This matter is taken up through hybrid mode.

Heard Mr. G. Satapathy, learned counsel for the Petitioner and Mr. A.K. Mishra, learned Additional Government Advocate appearing for the opposite parties. 3.

The petitioner has filed this writ petition seeking direction to the opposite parties to give chance to the petitioner to operate Saratchandrapur Stone Quarry, which is more than 1 km away from the ESZ, as has been recommended by the State Government vide Annexure-5 series and further to issue direction to opposite party no.2 to consider his representation under Annexure-7 after given opportunity of hearing to the petitioner.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made a representation to opposite party no.2 vide Annexure7 and the same may be directed to be considered within a stipulated time, to which learned counsel for the State has no objection.

As agreed to by learned counsel for the parties, this Court, without expressing any opinion on the merits of the

case, disposes of the writ petition directing opposite party no.2 to consider the representation filed by the petitioner vide Annexure-7, and pass appropriate order in accordance with law within a period of six weeks from the date of production of certified copy this order.

Issue urgent certified copy as per rules.
