The Petitioner in this CMP seeks to assail the order dated 27th April, 2022 passed by learned District Judge, Keonjhar in Test Case No. 3 of 2020 dismissing an application under Section 276 of the Indian Succession Act, 1925.

Learned counsel for the Petitioner submits that the order impugned herein is appealable. Hence, he prays for withdrawal of the CMP seeking liberty to file an appeal.

Granting such liberty, the CMP is disposed of as withdrawn.

Certified copy of the impugned order shall be returned to the learned counsel for the Petitioner on substitution of attested photocopy thereof.
