1. This is an application under Sec.439 Cr.P.C. for bail and the offences alleged are under Secs.420/120-B, I.P.C., Sections 4, 5 & 6 of the Prize Chits and Money Circulation Schemes (Banning) Act and Section 6 of the OPID Act.

2. Heard Mr. M. Kanungo, learned Senior Advocate for the Petitioner as well as Mr. A.K. Nayak, learned Advocate for the State (OPID).

3. Mr. Kanungo, learned Senior Advocate for the Petitioner submits that in the meantime seven witnesses have been examined in course of trial and thus he prays for withdrawal of the bail application with liberty to move the learned trial court afresh.

4. Accordingly, the BLAPL is disposed of as withdrawn granting liberty to the Petitioner as prayed for.
