Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel Mr. Trilochan Dash and associates have appeared on behalf of the informant. Their Vakalatnama is taken on record. Name of Mr. T. Dash be indicated in the brief as well as in the cause list.

The petitioner is an accused in T.R. Case No.284 of 2022, pending in the file of learned Additional Sessions Judge-cumSpecial Court (POCSO) Bhubaneswar, arising out of Balugaon P.S. Case No.111 of 2022, offence under Sections 363/366/376(2)(n)/373 of IPC read with Section 4 and 6 of the POCSO Act, 2012 and is in custody since 22.07.2022. 5.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge,

Bhubaneswar by order dated 11.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 7.

Considering the tenor thereof and taking into account the period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
