This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioners for anticipatory bail.

The petitioner is seeking pre-arrest bail in connection G.R. Case No.249 of 2008, arising out of Jagatsinghpur P.S. Case No.100 of 2022 pending in the court of learned S.D.J.M., Jagatsinghpur for commission of offence punishable under Sections 147/148/455/294/323/307/ 353/379/395/171-C/120-B/149 of the Indian Penal Code read with Section 29 of the Orissa Grama Panchayat Act, 1964 and Sections 135 and 135-A of Representation of People Act, 1951 and 1988. 5.
It is submitted by learned counsel for the petitioner that on similar footing with the present petitioner, other co-accused persons have already been released on bail by this Court in ABLAPL
// 2 // No.7378 of 2022 vide order dated 21.07.2022 and another ABLAPL No.2564 of 2022 vide order dated 30.03.2022.

Considering the nature of allegations made against the petitioners, it is directed that in the event the petitioners surrender before the learned S.D.J.M., Jagatsinghpur in the aforesaid case, he shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper with further conditions that while on bail, the petitioner shall not indulge any similar criminal activities and he shall cooperate with the investigating officer as and when required for the purpose of the investigation. Violation of any of the above conditions shall entail cancellation of bail.

The ABLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
