This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R. Case No.808 of 2022 pending in the file of learned S.D.J.M., Angul, arising out of Angul Sadar P.S Case No.403 of 2022, for commission of offence under Sections 341/294/323/307/506 IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Angul by order dated 09.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the State, on instruction, that the injury suffered by the injured is simple.

Learned counsel for the Petitioner submits that though the injured had suffered at the vital part but she is leading a normal life and that the Petitioner is the first offender. 7.

Taking into account the category of injury, as stated and the Petitioner is in custody since 9.8.2022 and filing of the charge sheet, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 8.

Accordingly, the BLAPL stands disposed of.
