This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the parties.

This is an application under Section 439 of the Code of Criminal Procedure filed by the Petitioner for bail in connection with Mohana P.S.Case No.67 of 2021, corresponding to G.R. No.53 of 2021, pending in the Court of the learned Sessions Judge-cumSpecial Judge, Gajapati at Parlakhemundi for alleged commission of offence under Sections 20(b)(ii)(C)/25/29 of the N.D.P.S.Act. 5.

Learned Counsel for the Petitioner submits that the Petitioner does not want to press this application at this juncture. He further seeks a direction to the trial court to expedite the trial and to conclude the same within a stipulated period of time.

Considering the submissions and custodial detention of the Petitioner since 09.03.2021, this Court directs the trial court to expedite the trial and conclude the same within a period of four

// 2 // months. In the event the trial is not concluded within the aforesaid period, the Petitioner is at liberty to move a fresh bail application. In the event a fresh bail application is filed the same shall be considered in accordance with law without being influenced by any other facts. 7.

With the aforesaid observation the bail application stands disposed of.
