This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T.(SPL) NDPS Case No.11 of 2022, pending in the file of learned Additional Sessions Judge-cum-Special Judge, Talcher, arising out of Samal Barrage P.S. Case No.215 of 2022, offence under Sections 21(b) of the NDPS Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Special Judge, Talcher by order dated 11.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

The contraband seized contains Codeine phosphate to the tune of 22 Grams which is admittedly less than commercial quantity

of 1kg and hence, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
