Heard learned counsel for the petitioner and learned counsel for the State.

The challenge in the present petition under Section 482 Cr.P.C. is to the impugned order dated 19th April, 2022 whereby the learned ACJM-cum-ASJ, Bhubaneswar issued NBW against him on the grounds stated therein.

Learned counsel for the petitioner submits that the petitioner was on bail but at the stage of framing of charge, he was found absent, for which, the impugned order under Annexure-1 was passed.

On a perusal of Annexure-1, the Court finds that the learned court below has not committed any error in directing issuance of NBW against the petitioner, as he had defaulted in his appearance. In other words, the order dated 19th April, 2022 need not be

interfered with by this Court in exercise of jurisdiction under Section 482 Cr.P.C.

Accordingly, it is ordered.

In the result, the CRLMC stands dismissed. However, petitioner is directed to surrender before the learned ACJM-cumASJ, Bhubaneswar in Crl. Trial Case No.127 of 2014 (arising out of Khandagiri P.S. Case No.151 of 2012 in connection with G.R. Case No.1295 of 2012) on or before 9th September, 2022 and in the event of his surrender, he shall be released on bail subject to conditions as would be found fit and proper in the facts and circumstances of the case.
