This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioners for anticipatory bail.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No.1434 of 2022, arising out of Berhampur Town P.S. Case No.164 of 2022 pending in the court of learned S.D.J.M., Berhampur for commission of offence punishable under Sections 409/34/420/468/467/471, I.P.C.

Considering the nature of allegation, gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioner. However, it is directed that in the event the petitioner surrenders before the learned court in seisin over the matter within a period of four weeks from today in the aforesaid case, he shall be released on bail on such terms and conditions as would be deemed
// 2 // just and proper with further conditions that while on bail, the petitioner shall not indulge any similar criminal activities and he shall not default in attendance of the court during trial on each date of posting.

It is further directed that the bail granted to the petitioner is subject to depositing the cash of Rs.50,000/-(rupees fifty thousand) before the learned court below, which shall be deposited in any Nationalized Bank in interest earning deposit initially for a period of one year renewable from time to time to be disbursed according to the final order passed in the present case.

Accordingly, the ABLAPL is disposed of.
