This Writ Petition is filed with an allegation that when the Petitioners as per their pleading in Paragraphs-7 & 8 of the Brief are in dire necessity of fund to meet medical necessities and have approached the Cuttack Development Authority for providing the required Form requesting for transfer of their plot and on being submitted the Development Authority is required to pass necessary orders.

This Writ Petition since involves non-providing of the required Form therein only and a lawful decision is required to be taken by the Competent Authority, this Court does not want to enter
// 2 // into merit involving the claim of the Petitioners though agitated by Mr.D.Mohapatra, learned counsel for the Development Authority at this stage. For the innocuous prayer involved herein, the Writ Petition stands disposed of directing the Cuttack Development Authority, O.P.2 to provide the Petitioners the necessary Form involving a request for transfer of plot on their attending its Office within three days hence. Considering the age of the Petitioners concerned, if the application for permission for transfer of the plot is filed within seven days hence, this Court hopes and expects that the Development Authority shall give a considered view in such application within a reasonable time. It is made clear that this Court has not expressed any opinion in either side at this stage and leaving the entire aspect for the Development Authority for its consideration.
