This writ petition involves the following prayer:- "It is therefore, most humbly prayed that this Hon'ble Court may be graciously pleased to:

i) Admit the writ application;

ii) Call for the records;

iii) To direct the Opposite Party No.2/ Collector, Khurda enquiry into the matter and pass appropriate order with a direction to the Block Development Officer, Balianta as well as Panchayat Executive Officer, Prataprudrapur Gram Panchayat release the deducted amount i.e. Rs.23,243/- out of Rs.5,00,000/- for the work "Creation of Pindi near Akhandaleswar Temple and another Rs.5,00,000/- for construction of Panchayat Road in the Prtaprudrapur Panchayat in the district of Khurda within a stipulated period.

iv) And further be pleased to pass any other order(s) / direction(s) as would be deemed

// 2 // just and proper in the interest of justice."

Considering the submissions made by the parties and as a representation at the instance of the Petitioner on the selfsame issue is still pending before the Collector, Khurda, this Court directs the Collector, Khurda to consider the representation at the instance of the Petitioner vide Annexure-3 and take a lawful decision in the matter taking into account the grounds stated in this writ petition so also the documents appended thereto.

The entire exercise shall be completed within a period of one & half months from the date of communication of an authenticated copy of this order along with a copy of the Writ Petition by the Petitioner.

Let an extra copy of the brief be served on the learned State Counsel for necessary communication.
