1. This is an application under Sec.439 Cr.P.C. for bail and the offence alleged is under Sec.302, I.P.C.

2. Heard Mr. L. Bhuyan, learned counsel for the Petitioner as well as Mr. K. Das, learned A.S.C. for the State-Opposite Party.

3. This is a case of double murder.

4. Mr. Bhuyan submits on behalf of the Petitioner that he is inside custody since 12.9.2019 and the story narrated by the eye-witness is improbable.

5. Upon hearing Mr. K. Das, learned A.S.C. for the StateOpposite Party and perusal of the copies of the depositions of twelve witnesses examined till date for prosecution, as produced by Mr. Bhuyan, it reveals that P.W.4-Matai Munda has clearly stated about eye-witnessing of the occurrence through the window of his room. Having seen the depositions of all such

witnesses, particularly P.W.2 and P.W.4, I am not inclined to release the Petitioner on bail. Accordingly, the prayer for bail is rejected.

6. The BLAPL is dismissed.
