Heard Mr. Jayadeba Behera, learned counsel for the petitioner and Mr. S.S. Mohapatra, learned Additional Standing Counsel for the State.

On perusal of the record, it is seen that the learned Court below has issued summons to the accused-petitioner after taking cognizance. Learned counsel for the petitioner prays for withdrawal of the present CRLMC assailing the order of the cognizance to appear before the learned Court below and the learned Court below shall proceed in accordance with law. 4.

Keeping in view, the law laid down relating to issuance of summons vis-à-vis the appearance of the accused. 5.

With such observation, the CRLMC is disposed of. 6.
