The Petitioner is a defaulter in two loan accounts i.e., Cash Credit Loan and Term Loan of aggregating around Rs.53.00 lakhs availed on 24th July, 2013 from the Bank of India, Keonjhar Branch, Keonjhar. The recovery process under SARAFESI Act, 2002 has culminated into issuance of e-auction sale notice dated 23rd July, 2022 fixing the auction sale of the secured asset on 25th August, 2022, which is the subject matter of challenge before this Court.

At the time of hearing, Mr. T.K.J. Samanta, counsel for the Petitioner submits that the present writ petition has become infructuous in view of the auction fixed for 25th August, 2022 having attracted no bidders.
