Heard Mr. P.P. Behera, learned counsel for the petitioners, Mr. H.M. Dhal, learned Additional Government Advocate and Mr. Debasis Nayak, learned counsel representing Opposite Party Nos.3, 4 & 5.

Mr. Behera, learned counsel for the petitioners submits that the present petitioners were carrying on their business as Street Vendors at Press Chhaka area of Khapuria, Cuttack, for so many years before being recently evicted from their place of business.During course of hearing, he fairly submits that the petitioners do not have certificates of street vending and accordingly wants to withdraw this petition with liberty to file Form-2 applications for grant of such certificate as envisaged under the Odisha Street Vendors (Protection of
// 2 // Livelihood and Regulation of Street Vending) Scheme, 2015. He further submits that Opposite Party Nos.3 & 4 be directed to take a decision on such applications within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioners to file appropriate application for getting the certificates of street vending as permitted under the law within a period of ten days along with the required informations under the above noted Scheme. In the event, such applications are filed, the Opposite Party Nos.3 & 4 are directed to take a decision on the same in accordance with law within a period of 8 weeks and communicate the result of such exercise to the petitioners.

The writ petition is accordingly disposed of. 5.
Urgent certified copy of the order be granted on proper application.
