This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are accused in C.T. Case No.75 of 2022 pending in the file of learned Sessions Judge, Koraput at Jeypore, arising out of Borigumma P.S. Case No.2 of 2022 for offences under Sections 304/201/34 IPC and Section 39 of the Indian Electricity Act.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Koraput-Jeypore by order dated 03.08.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Perused the case diary.

It is submitted by the learned counsel for the Petitioners that the co-accused have already been released on bail by this Court in BLAPL No.6275 of 2022 by order dated 25.07.2022. 7.
Taking into account the release of the co-accused, who are prima facie similarly circumstanced, this Court directs the Petitioners to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
