This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.779 of 2022 pending in the file of learned S.D.J.M., Bhawanipatna, arising out of Lanjigarh P.S. Case No.39 of 2022, offence under Sections 341/376/511/354/354-A/354B/354D/294/506 of IPC and is in custody since 08.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bhawanipatna by order dated 05.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection and 161 Cr.P.C. statement of the victim.

Taking into account the nature of allegations and the accusations and as the investigation has progressed substantially, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 7.
Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per rule. .
