1.This matter is taken up through hybrid mode.

2. Heard.

3. In this writ petition the petitioner challenges the arbitrary action of the Opposite Parties in not granting the benefits of 2nd and 3rd ACP scale of payment and other consequential benefits of him.

4. Learned counsel for the petitioner submits that though the petitioner has superannuated from his service, in the meantime, he is not receiving his pensionary benefits as per the revised salary. He further submits that case of the petitioner is covered by the settled position of law as well as the Notification of the Opposite Parties. In spite of the

// 2 // same the Opposite Parties are not considering the case of the Petitioner.

5. At this stage learned counsel for the petitioner submits that the petitioner has filed a representation before the Block Education Officer, Balangir. The same is still pending before the authority. Therefore, he submits that the authority may be directed to dispose of the same within a stipulated time.

6. In view of pendency of such representation, the opposite party No. 4- Block Education Officer, Balangir is directed to decide the representation of the petitioner and pass a reasoned order keeping in view the Annexure-2 series, within a period of 30 days from the date of production/presentation of certified copy of this order along with a copy of this Writ Petition.

5. Accordingly, this writ petition is disposed of.

6. Urgent certified copy of this order be granted on proper application.
