This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.1194 of 2022 pending in the file of learned S.D.J.M., Khurda, arising out of Khurda P.S. Case No.0356 of 2022, offence under Sections 420/120-B/34 of IPC and is in custody since 30.07.2022. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Khurda by order dated 11.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by the learned counsel for the petitioner that one of the co-accused Dipu Mohapatra has since been released on
anticipatory bail by this Court by order dated 04.08.2022 in ABLAPL No.9577 of 2022.

Considering the age of the petitioner and the role ascribed to him and keeping in view the submission by the learned counsel for the petitioner that the petitioner has no criminal antecedent, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.
Since it is submitted by the learned counsel for the petitioner that the petitioner has no criminal proclivity, while enlarging the petitioner on bail the learned court below shall verify such assertion. If it comes to the fore that the petitioner has any criminal antecedent this order shall stands recalled. 9.
Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per rule. .
