This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and the learned Additional Government Advocate. Perused the records. 3.
This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

It is submitted by the learned counsel for the Petitioner that the main allegation against the principal accused Bighnesh Nayak, who had assaulted by means of sword and thrown a bomb at the spot. It is further submitted by the learned counsel for the Petitioner that the principal accused has already been arrested in the present case and forwarded to judicial custody. So far as the principal accused is concerned, it is alleged that he was present at the spot, abused the
// 2 // informant and others in filthy language.

Considering the nature of allegations made, gravity of the offence and the facts of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the learned J.M.F.C., Narasinghpur in C.T.Case No.269 of 2022 arising out of Narasinghpur P.S.Case No.160 of 2022 within a period of three weeks from today and moves for bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Magistrate and subject to verification of criminal antecedents of similar nature against the Petitioner. In the event it is found that the Petitioner has more than one criminal antecedent of similar nature, then this order shall not be given effect to. 6.
Accordingly, the ABLAPL is disposed of.
