Heard Mr. G.Mohapatra, learned counsel for the Petitioner and Mr. Panigrahi, learned Addl. Standing Counsel for the State-Opposite Party.

The Petitioner is aggrieved by the order dated 06.07.2022 passed by the Opposite Party No.1 under Annexure-1.

This Court after going through the same finds such an order has been passed in view of the order of conviction and sentence passed against the Petitioner in Cuttack Vigilance P.S. Case No.40 of 2000.

Mr. Mohapatra, learned counsel for the Petitioner fairly submitted that against the order of conviction and sentence passed against the Petitioner, he has approached

// 2 // this Court in Criminal Appeal No. 492 of 2015, which is sub-judice before this Court.

In view of the admitted fact that the Petitioner is a convicted employee, this Court finds no illegality or irregularity in the order dated 06.07.2022 under Annexure-1 and accordingly this Court is not inclined to entertain the same. However, while disposing the Writ Petition, it is observed that the said order shall be subject to final outcome of the Criminal Appeal No. 492 of 2015. (Biraja Prasanna Satapathy) Judge Subrat
