1. This is an application under Sec.439 Cr.P.C. for bail and the offences alleged are under Secs.376(3)/376(2)(n)/354-B/506, I.P.C. and Sec.6 of the POCSO Act.
2. Heard Mr. K. Mohanty, learned counsel for the Petitioner as well as Ms. S. Mishra, learned A.S.C. for the State-Opposite Party.
3. Considering the nature of allegations and the statement of the victim recorded under Sec.164, Cr.P.C., I am not inclined to release the Petitioner on bail. Accordingly, the prayer for bail is rejected.
4. The BLAPL is dismissed.
5. However, as prayed for by the Petitioner, he is at liberty to renew his prayer for bail after examination of the victim in course of trial.
