Heard Mr. A.R. Panda, learned counsel for the petitioners and Mr. Rajesh Tripathy, learned Additional Standing Counsel for the State.

The ABLAPL is disposed of as infructuous so far as the petitioner no.2- Sushanta Behera is concerned, since he has not been cited as accused in the charge-sheet, as stated by learned counsel for the petitioners.

So far as Petitioner No.1-Ganga @ Gangadhar Das is concerned, in view of issuance of notice under Section-41 (A) of the Cr.P.C., the present ABLAPL is disposed of as not maintainable.

On instruction, the learned counsel for the State submits that the father's name of petitioner No.1 in the charge sheet has been described as 'Khana Das'.

The ABLAPL stands disposed of accordingly.
