Heard learned counsel for the parties.

The petitioner had appeared in the +2 Science Examination of 2021-22 from Maa Samaleswari Higher Secondary School of Science and Technology. On the date of English Examination, i.e. on 09.05.2022 a flying squad visited the Center and booked the petitioner for malpractice. The petitioner claims that he had not indulged in any kind of malpractice but was wrongly booked. It is his further case that if the CCTV footage during time of the visit of the flying squad is considered, his innocence will be automatically proved. Ventilating his grievance in this regard, the petitioner submitted a representation before the Principal, Barpali College, Barpali, where the examination was being conducted. Such representation was forwarded to the Controller of Examinations, CHSE, Odisha by the Principal, Barpali College, Barpali on 27.06.2022. It is submitted that no action has been taken on the representation as yet.

Since the matter is pending before the appropriate authority, without expressing any opinion on the merits of the case, the writ petition is disposed of directing the Controller of Examinations,
CHSE, Bhubaneswar (opposite party no.2) to consider the representation so forwarded by the Principal, Barpali College within a period of four weeks and to dispose of the same in accordance with the rules and regulations in place by passing a reasoned order within a period of four weeks from the date of communication of this order or on production of certified copy thereof by the petitioner. The decision so taken shall be intimated to the petitioner as soon as possible.

Writ petition is disposed of accordingly.

Issue urgent certified copy as per rules.
