The Petitioner in this writ petition seeks to assail the decision taken in 296th meeting of the State Transport Authority, Odisha by rejecting his application for renewal of permanent permit granted in respect of his vehicle bearing Registration No. OR-11G-7646 (Stage Carriage) on the inter-State route from Phulbani to Tata.

In course of hearing, Mr. Biswal, learned counsel for the Petitioner submits that the aforesaid route has been advertised as per Annexure-9 to the writ petition. Hence, he prays for withdrawal of the writ petition to make a fresh application for grant of permanent permit in the aforesaid inter-State route and also prays for a direction to the authorities to consider the same in accordance with law.

Mr. Behera, learned Standing Counsel for Transport Department submits that pursuant to the advertisement made under Annexure-9, no one has made any application and the
// 2 // said route is still lying vacant without any operator. As such, the Petitioner may make an application, which can be considered in accordance with law.
In view of the submissions made by learned counsel for the parties, this writ petition is disposed of as withdrawn with an observation that in the event the Petitioner makes an application for grant of permanent permit in respect of the inter-State route from Phulbani to Tata, the same shall be considered by the State Transport Authority in accordance with law.
Urgent certified copy of this order be granted on proper application.
