Heard Mr. S. Jena, learned counsel for the Petitioner and Mr. A.K. Mishra, learned Additional Government Advocate appearing for the opposite parties.

The petitioner has filed this writ petition seeking to quash the Advertisement dated 01.08.2022 in respect of the Lehergaon Sand Quarry in the Tahasil of Jharbandh in the district of Bargarh vide Annexure-2 floated by opposite party no.3 and further to issue direction to opposite party no.3 to implement the order dated 30.07.2021 vide Annexure-1 by allowing the petitioner to operate Lehergaon Sand Quarry for a period of 5(five) years on such terms and conditions. 4.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made a representation to opposite party no.3 vide Annexure4 and the same may be directed to be considered within a stipulated time, to which learned counsel for the State has no objection.

As agreed to by learned counsel for the parties, this Court, without expressing any opinion on the merits of the

case, disposes of the writ petition directing opposite party no.3 to consider the representation filed by the petitioner vide Annexure-4, and pass appropriate order in accordance with law within a period of six weeks from the date of production of certified copy this order.

Issue urgent certified copy as per rules.
