Misc. Case No.1706 of 2016 & MACA No.1016 of 2016 07.

The matter is taken up through hybrid mode.

Heard Mr. B. Singh, learned counsel for the Appellants and Mr. G.P. Dutta, learned counsel for insurer - Respondent No.2. 3.

There is delay of 310 days in filing the appeal. 4.

It is submitted that the Appellants are poor claimants and due to their illiteracy and ignorance the delay in filing the appeal occurred. 5.

It is seen that the award is dated 11th August, 2015. Admittedly the claimants have received the award amount as per direction of the tribunal in time prior to filing of the appeal. Thus, the reasons as explained in the Misc. Case are not found satisfactory for condoning the delay and as such this court is not inclined to condone the delay. 6.

The Misc. Case is dismissed.

Consequently, the appeal is dismissed on the ground of limitation.
