This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in G.R. Case No.2389 of 2022 arising out of Ainthapali P.S. Case No.354 of 2022, pending in the Court of learned S.D.J.M., Sambalpur, for alleged commission of offences under Section 420 of IPC read with Section 66(C)/66(D) of Information Technology Act..

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cum-Spl. Court, (under POCSO Act), Sambalpur, by order dated 19.07.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Learned counsel for the petitioner submits that in the meanwhile charge-sheet has already been filed, his further continuance in custody is uncalled for.

Learned counsel for the State opposes the prayer for bail and on the basis of the recitals in the Case Diary submits that there are criminal antecedents of similar nature.

Considering the nature of allegations and the punishment prescribed, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.
Additionally it is directed that the petitioner shall appear before the jurisdictional police station once every week till conclusion of trial.

Accordingly, the BLAPL stands disposed of.
