2. Heard Mr. J.P.Pattnaik, learned Government Advocate for the petitioners-State and Mr. P.K.Mohapatra, learned counsel for the sole opp. party.

The petitioners-State have preferred the present writ petition assailing the order dated 07.08.2018 passed by the Odisha Administrative Tribunal, Bhubaneswar in O.A. No.1585 of 2018 by which the tribunal had directed for issuance of formal order of regular appointment in favour of the opp. party with effect from 1.7.2014 with all consequential service and financial benefits within a period of three months from the date of receipt of a copy the said order.

While passing such order, the tribunal has relied upon a judgment of the Division Bench of Odisha Administrative Tribunal, Bhubaneswar in O.A. No.2172 (C) of 2015 and batch (Jatin Kumar Das v. State of Odisha and another) disposed of on 17.5.2017, but the said order was challenged
before this Court in W.P. (C) No.6661 of 2018, which was dismissed vide order dated 10.05.2018. Against the said order, the State has preferred Special Leave to Appeal before the apex Court in SLP No.18642 of 2018 and the same has also been dismissed.

In view of the facts and circumstances of the case, we are not inclined to interfere with the order dated 07.08.2018 passed by the Odisha Administrative Tribunal, Bhubaneswar in O.A. No.1585 of 2018 and the present writ petition stands disposed of in terms of the decision in the case of Jatin Kumar Das (supra) which was confirmed by the apex Court.
