This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No.203-B of 2008, arising out of Kotagarh P.S. Case No.28 of 2008 pending in the court of learned J.M.F.C., Kotagarh for commission of offence punishable under Sections 147/148/149/ 427/436/435/506/380/452, I.P.C.

Considering the nature of allegation, gravity of offence and the facts of the case, I am not inclined to grant anticipatory bail to the petitioner. However, it is directed that in the event the petitioner surrenders and moves for bail before the learned J.M.F.C., Kotagarh within a period of three weeks from today in the aforesaid G.R. Case,

Accordingly, the ABLAPL is disposed of.
