Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in G.R. Case No.356(G) of 2008, pending in the file of learned Additional District and Sessions Judge, Balliguda, S.T. Case No.55 of 2022 arising out of G. Udayagiri P.S. Case No.102 of 2008, under Section 147/ 148/ 436/ 427/ 341/ 323/ 324/ 325/ 326/ 302/ 379/ 307/ 120(B) and 149 of IPC read with Section 25/27 of the Arms Act and Section 9-B of the India Explosive Act and is in custody since 28.05.2022. 4.
Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge, Balliguda by order dated 05.08.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that co-accused has been released on bail by order of this Court dated 10.11.2021 in BLAPL No.8390 of 2021; he seeks release of the petitioner inter alia on the ground of parity.

Considering the submissions of the learned counsel for the petitioner and release of the co-accused and period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.
Accordingly, the BLAPL stands disposed of.
