1. This matter is taken up through hybrid arrangement.
2. Heard.
3. The Petitioners, in this Writ Petition, challenges the action of the Opposite Parties in not considering/ sanctioning the family pension in their favour since July, 2007.
4. Learned counsel for the Petitioners submits that the father of the Petitioners died in a road accident on 29.06.2007 while he was serving as an Assistant Teacher of GNUVP School, Salangipada, in the district of Nuapada.
5. Learned counsel for the Petitioners submits that they had submitted the legal heir certificate issued by the
// 2 // Tahasildar, Komana to the Headmaster of the School and the Headmaster has sent it to the Opposite Party No.4/ District Education Officer, Nuapada. Since the complete paper was not there, the Opposite Party No.2/ Controller of Accounts, Odisha, Bhubaneswar raised objection.
6. In such view of the matter, the Petitioners are directed to approach the Opposite Party No.4/ District Education Officer, Nuapada by filing an application along with a copy of this order. On such event, the Opposite Party No.4/ District Education Officer, Nuapada shall make all arrangement and solve the problem of the Petitioners as early as possible preferably within a period of one month from the date of submission/ production of this order. If any deficiency is pointed by the Opposite Party No.4/ District Education Officer, Nuapada, the Petitioners shall comply and do needful.
7. Accordingly, this Writ Petition is disposed of.
8. Urgent certified copy of this order be granted on proper application.
