1. This matter is taken up through hybrid mode.

2. Heard learned counsel for the Petitioner and learned counsel appearing for the Opposite Parties.

The Petitioner being represented by his father guardian has filed this Writ Petition with the grievance that though his name is 'Himanshu Priyadarshan Dash', the same was wrongly mentioned as 'Himansu Priyadarsana Das'. Further, in the H.S.C. Examination Certificate issued by the Board of Secondary Education his date of birth was wrongly mentioned as '16.11.2004' instead of '17.11.2004'. The Petitioner relies upon the certificate dated 21st April, 2018 issued by the Pradhan Acharya, Saraswati Sishu Vidya Mandir, Markat

// 2 // Nagar, Cuttack in support of his contention. The Petitioner also relies upon the birth certificate issued by the Khaira CHC.

Learned counsel appearing for the Board of Secondary Education submits that correction of the particulars in the certificate can be made only as per the provisions under Regulation 39 of the Board of Secondary Education Regulations and that the student has to apply through the Headmaster of the concerned School for the same.

5. Such being the position and without expressing any opinion on the merits of the case, the Writ Petition is disposed of granting liberty to the Petitioner to submit a representation before the Headmaster of the concerned School within a period of two weeks ventilating his grievance. In the event such representation is filed within the aforesaid period, the Headmaster shall transmit the same to the Board of Secondary Education with his comments/observations within a period of two weeks thereafter. Upon receipt of the representation as forwarded by the Headmaster, the Board of Secondary Education shall consider the same in accordance with law and dispose of the same within a period of two weeks.

6. Urgent certified copy of this order be granted on proper application.
