Instant I.A. is filed for extension of time for the petitioner to surrender before the learned court below in compliance of the Courts' order dated 5th September, 2023 in CRLMC No.2259 of 2022.

Heard learned counsel for the petitioner and State. 3.

Learned counsel for the petitioner submits that the accused was in Chennai on labour work and hence, could not surrender within the time stipulated and as such, there was a communication lapse and hence, therefore, extension of time is pleaded. 4.

Considering the above submission, the Court is inclined to extend the time for the petitioner to surrender before the learned court below.

I.A. stands allowed.

Consequently, the petitioner is directed to surrender before the learned Additional Sessions Judge, Dharamgarh in connection with C.T. No.16 of 2021 (Sessions) on or before 31st January, 2024. It is made clear that there shall be no further extension in future. 7.

Rest part of the order shall remain unaltered. 8.

The I.A. is accordingly disposed of.
