Heard learned counsel for the Parties.

Through the Writ Petition and the pending representation, Mr.Mohanty, learned counsel for the Petitioner objects the construction of Gram Panchayat building over the plot decided to have the Anganwadi Centre but in a village land.

It is alleged that there is already determination of a plot to have Anganwadi Centre, looking to the convenience of all concerned through the documents, Petitioners establish there has been even Panchayat objection at the level of Sarapanch also for this construction, this apart Annexure-5 also appears to have been submitted by number of persons in the village.

Keeping all these in view, while observing that the construction of Anganwadi Centre since benefit the villagers, there should be ought most care in site selections. This Court accordingly directs the Collector-cum-District Magistrate, Puri- Opposite Party No.3 to consider the objection of the villagers at Annexure-5 in the matter of construction of Anganwadi Centre also taking into account the plea in
// 2 // the Writ Petition by undertaking such exercise at least within a period of one month from the date of communication of order by the Petitioner.

This Court further directs in the event construction of the Anganwadi Centre, as alleged, has not been commenced, same may not be commenced at least a decision is taken by the Collector involving the selected representatives of the villagers. (Biswanath Rath) Judge Swarna
