Minati Behera v. Pradeep Kumar Sahoo, Tahasildar, Bhubaneswar
IN THE HIGH COURT OF ORISSA AT CUTTACK
CONTC No.5029 of 2021 Minati Behera ....
Petitioner(s) Mr. P.K. Jena, Advocate -versusPradeep Kumar Sahoo, Tahasildar, Bhubaneswar ....
Opposite Party(s) Mr. S. Ghose, Advocate
CORAM:
JUSTICE BISWANATH RATH
ORDER
07.07.2022 Order No.
03.
1.
The matter at hand is in the second contempt alleging non-compliance of the order of this Court dated 28.06.2021 passed in CONTC No.1775 of 2021 arising out of the order dated 14.09.2020 passed in W.P.(C) No.22716 of 2020.
2.
This Court finds, in disposal of the W.P.(C) No.22716 of 2020, there was a direction to the competent authority to conclude the proceeding vide OLR Case No.100 of 2012 within a period of two weeks after resumption of the office work. It is alleged that even after disposal of the first contempt there was no disposal of the above noted OLR Case compelling the Petitioner to come in the second contempt. 3.
Mr. Ghose, learned counsel for the Opposite Party-contemnor produces the order-sheet in OLR Case No.100 of 2012 in Court today. 4.
On perusal of the records produced by Mr. Ghose, learned counsel for the Opposite Party, this Court finds, the proceeding has been disposed of finally by the order of the Addl. Tahasildar,
// 2 // Bhubaneswar dated 7.05.2022 but with an order of rejection. Since the OLR proceeding has already been disposed of in the meantime, this Court finds, no cause of action survives in this contempt petition, which is, hereby, dropped. It is, however, made clear that if the Petitioner is aggrieved by such order, she is at liberty to approach under appropriate law.
(Biswanath Rath) Judge Ayaskanta Jena
