The Writ Petition involves rejection of a demarcation exercise by the Competent Authority under holding the Petitioner is not the occupier of the land, on the other hand, there is other occupier available.

In the circumstance and for the controversy involved in the demarcation proceeding, the Petitioner has no other escape than to approach the Civil Court to get appropriate declaration in her favour. 4.
