This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in C.T. Case No.33 of 2021 arising out of P.S. Case No.28 on 13.03.2021, Puruna Katak, Boudh, pending in the Court of learned J.M.F.C., Harabhanga, Boudh, for alleged commission of offences under Sections 409/420/506 of IPC.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Boudh, by order dated 06.08.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations and the punishment prescribed and keeping in view that the petitioner is in custody since 19.07.2022, this Court directs the petitioner to be

released on bail on such terms to be fixed by the Court in seisin over the matter.

Taking note of the submission of learned counsel for the petitioner that the petitioner has no criminal proclivity. While so releasing the learned Court in seisin over the matter shall verify as to whether the petitioner has any criminal antecedent, in the event it comes to the fore that the petitioner has any criminal antecedent, the order shall stand recalled without any further reference to this Court.

Accordingly, the BLAPL stands disposed of.
