This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Bhawanipatna Sadar P.S. Case No.212 of 2022 corresponding to C.T. Case No.643 of 2022, pending in the Court of learned S.D.J.M., Bhawanipatna, for alleged commission of offences under Sections 366/376(2)(n)/506 of IPC.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bhawanipatna, by order dated 17.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Learned counsel for the petitioner submitted the 164 Cr.P.C. statement of the victim which is taken on record. 7.

Considering the tenor thereof and taking into account the submission of the learned counsel for the petitioner on the basis of

the final form, copy of which is submitted in Court that chargesheet has already been filed on 30.07.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. Copies of final form and the 164 Cr.P.C statement be kept on record.

Accordingly, the BLAPL stands disposed of.
