Heard Ms. P.P. Mohanty, learned counsel for the petitioners and Mr. D.K. Mohanty, learned Additional Standing Counsel.

According to Ms. Mohanty, the petitioner Nos.1 & 2 are aggrieved by rejection of their claim under Annexure-2 by the Sub-Collector, Kamakhyanagar (opposite party no.2) for being covered under displaced category and thereby depriving them of their legitimate benefits under the Odisha Rehabilitation and Resettlement Policy 2006. Name of petitioner No.3 is not at all there in the said Annexure, though he is also entitled to receive the benefits under the above policy. During course of hearing, she submits that liberty may be granted to the petitioners to approach the Collector, Dhenkanal (opposite party no.1) by filing a representation for redressal of their grievances and further prays that the said opposite party be directed to take a decision

// 2 // on such representation within a stipulated time period. 3.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioners to approach the opposite party no.1 by filing a representation along with a certified copy of this order through Registered Post within a period of two weeks. In the event, such an application is filed before opposite party no.1, he/she is directed to take a decision on the same in accordance with law within a period of three months from the date of receiving of such representation after giving reasonable opportunity of hearing to the petitioners and communicate the result of such exercise to the petitioners.

The writ application is accordingly disposed of. 5.

Urgent certified copy of this order be granted on proper application.
