This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in T.R. Case No.195 of 2022 pending in the file of learned Additional District and Sessions Judge-cum-Special Judge, (POCSO) Bhubaneswar, arising out of Khordha Model P.S. Case No.221 of 2022, offence under Sections 376(2)(n)/294/506/363/34 of IPC read with Section 6 of POCSO Act, 2012 and is in custody since 23.05.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bhubaneswar by order dated 16.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim.

Considering the tenor thereof and keeping in view the substantial progress of investigation, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per rule. .
